And with global media attention still on COP27, the state of the environment is atop a long list of topics of interest at the moment. Perhaps less attention paid—but of no less importance to the environmental policies needed to address current concerns—is the reform underway of the Canadian Environmental Protection Act (CEPA), Canada’s most important environmental health law. While CEPA is a critical law for Canada and the people who live and work here, many are largely unfamiliar with it. In a nutshell, CEPA is an act “respecting pollution prevention and the protection of the environment and human health in order to contribute to sustainable development.” Not only is there a lack of knowledge about what CEPA is and does, but there is also a lack of understanding of how the law and its provisions are out of date. A modernized CEPA with a stronger legislative framework for assessing and controlling toxic substances—including greenhouse gasses (GHGs)—and protecting the right to a healthy environment is an urgent priority. CEPA has not been significantly amended for more than two decades, despite the five-year review time frame to which the act is supposed to adhere. That, and the sources of pollution and our scientific understanding of risks and impacts on communities have changed dramatically in the time frame since its last major update.
