"Giuffre's complaint should be dismissed because this Court lacks subject matter jurisdiction over the action, due to Giuffre's improper assertion of diversity jurisdiction notwithstanding that she is a permanent resident of Australia and not a domiciliary of Colorado," it said. Ms Giuffre, 38, alleged she was trafficked by late-financier Jeffrey Epstein, convicted sex trafficker Ghislaine Maxwell, and was forced to have sex with the British royal between 2000 and 2002.The 38-year-old alleged she was pushed to have sex with the Duke on three occasions - at Maxwell's home in London, during a visit to Epstein's private island Little St James and in the US Virgin Islands.
Prince Andrew has repeatedly denied the allegations and insisted he had"no recollection" of meeting her but his motion to dismiss the lawsuit was ruled"legally insufficient". Earlier this month, a US judge ruled in favour of Ms Giuffre's legal team, adding"the defendant's motion to dismiss the complaint for a more definite statement is denied in all respects".
