Attorney-General Christian Porter has accepted the bungled 'robodebt' scheme was unlawful and has not ruled out the Commonwealth paying damages to the hundreds of thousands of Australians | Gallo_Ways

"We received advice at the time that the program was put together that it was lawful. Many governments have used ATO averaging data over many years, Labor and Liberal."

"What we do acknowledge is that using average annualised ATO data has been shown to be an insufficient basis for raising the debts," he said."That system was also not a sufficient basis for raising debts, even before the automation ... civilly, it was unlawful. There was no lawful basis for it." Mr Porter said he couldn't apologise for the bungled scheme for legal reasons as the class action was still ongoing.

Asked about the prospect of paying out damages, Mr Porter said: "That’s something that we dealt with in mediation and no doubt that’s a position that will be put by the class action."
