A judge has ordered the release from custody of two Sydney brothers accused of grossly neglecting their ailing mother

The prosecution alleges the men were grossly negligent, having been aware in the preceding month of her deteriorating condition - including the bedsores and the significant wound - and the need for medical attention.But the defence contended the mother consistently refused any medical help and made her own decisions about her lifestyle including what, if and when she ate.

In a police interview played on Thursday, Phillip Thompson repeatedly said he and his brother looked after her to the best of their abilities, while stressing they were not medical professionals. Mr Thompson said his "withdrawn" brother was the main carer of their mother after their father died of a heart attack at home in 2012.

She hadn't seen or wanted to see a doctor for many years but, after she developed knee problems, he bought her a walking stick on eBay, he said.Mr Thompson said he had suspected his mother was dying and that her body had just shut down."I also suspect them sores she had on her have possibly played a part in her infection."

Their mother had insisted on not getting any help as, he said, "She didn't want to die in a nursing home and she didn't want to die in a hospital.""Just being, ah, forgotten and neglected, and everything else," he said.
