A landmark data access agreement being negotiated between the United States and Australia to aid law enforcement is at risk because of Australian legislation targeting encrypted communications, according to the chairman of a US congressional committee responsible for reviewing the arrangements.

However, Jerrold Nadler, chairman of the US House of Representatives judiciary committee, has written to Home Affairs Minister Peter Dutton to express concerns about Australia's "Assistance and Access" lawsAdvertisement The Law Council of Australia and tech companies warned the encryption legislation might scuttle a CLOUD Act agreement by undermining protections for user privacy and disqualifying Australia from meeting certain conditions.

Announcing the start of negotiations in Washington, Mr Dutton said current processes for obtaining data from US companies risked loss of evidence and "unacceptable delays" in criminal investigations.
