The Commonwealth Bank joins McDonald’s in facing claims for millions of dollars of backpay because they allegedly did not allow staff to take ten-minute rest breaks.

The Commonwealth Bank is facing legal action over its alleged systemic failure to allow retail banking staff to take paid tea breaks, with the union claiming the practice has netted the bank some $45 million worth of free work over the past six years.

“Our members working in bank branches are entitled to these rest breaks but most are never able to take them because of under-staffing,” Ms Angrisano said.“This is wage theft. Make no mistake, if you aren’t able to take a paid rest break, then you’re having ten minutes of time stolen from you. It adds up very fast. We estimate this claim to be worth at least $45 million across 3000 workers.”

The union’s court case sets out evidence for a small sample group of employees, paid between $22 and $41 an hour at various points. However, it then seeks orders for the bank to audit its entire workforce covered by enterprise agreements and toMs Angrisano said the tea breaks were intended to give banking staff a short rest from continuous face-to-face service to customers.
